The Temporary Residence and Work Authorization as an Employee is the permit that enables non-EU foreigners to reside and carry out work activity for an employer in Spain. It is the standard procedure for joining the Spanish labor market with all legal guarantees.

Procedure Information

📋 Main Requirements

National Employment Situation: For the authorization to be granted, the national employment situation must allow hiring. This is met if:

  • The occupation is in the Catalog of Hard-to-Fill Occupations.
  • Or the employer accredits the difficulty of filling the position (certificate from the Public Employment Service).
  • Or there are preferences (children of residents, nationals of Chile/Peru, etc.).

Worker Requirements:

  • Not being a citizen of the EU/EEA/Switzerland.
  • Not being in an irregular situation in Spain.
  • No criminal record (in Spain and previous countries).
  • Possess the degree or professional qualification required for the position.

Employer Requirements:

  • Be registered with Social Security and up to date with payments.
  • Guarantee continued activity during the validity of the permit.
  • Have sufficient economic means for the project and salary payment.
  • The contract must be signed by both parties and its validity be conditional upon authorization.
📄 Required Documentation

General Documents:

  • Application form official model (EX-03).
  • Copy of the worker's complete passport.
  • Degree or accreditation of professional training (officially recognized if necessary).

Company Documents:

  • NIF/CIF and company deeds.
  • Identity document of the legal representative.
  • Employment contract signed.
  • Accreditation of economic means (IRPF/VAT/Corporate Tax returns).
  • Descriptive report of the occupation.

Important:

  • The application is submitted by the employer (or their representative) before the Immigration Office of the province where the work will be performed.
  • Fees: The residence fees (fee 790 code 052) and work fees (form 790-062) must be paid.
