Changes of Situation: Adapt Your Permit to Your Needs

Changes of Authorization Type:

1. From Employed to Self-Employed (from employee to self-employed)

   • Requirement: Having resided at least 1 year with authorization enabling work
   • Documentation: Business plan, investment, necessary licenses

2. From Self-Employed to Employed (from self-employed to employee)

   • Requirement: Having valid self-employed authorization
   • Documentation: Employment contract compliant with regulations

3. From Studies to Work

   • Requirement: Having completed higher education or vocational training
   • Employment contract according to qualification
   • Not necessary to first apply for job search permit

4. From Arraigo to General Work

   • After initial arraigo renewal
   • Moving to ordinary residence and work permit

5. Change of Employer or Sector

   • With valid employed work authorization
   • If less than 1 year has passed: limited to province and similar occupation
   • If more than 1 year has passed: without geographic or sectoral limitations

General Requirements:

• Have valid residence authorization
• Have no criminal record
• Meet specific requirements of the type of authorization you are requesting
• Pay corresponding fees

Basic Documents:

• Application form according to type of modification:
  • EX-03: Change of situation
  • EX-07: For change to self-employed
• Copy of passport or NIE
• TIE (Foreigner Identity Card) currently valid

For Modification to Employed:

• Employment contract signed by both parties
• Employer certificate of being up to date with obligations
• Descriptive report of the company's activity

For Modification to Self-Employed:

• Business project documentation
• Necessary licenses and authorizations
• Proof of investment and economic means
• Professional qualification (if required)

For Change of Employer (less than 1 year):

• Employment contract in the same province
• Same occupation or professional group

For Change of Employer (more than 1 year):

• Employment contract (without geographic or sector restrictions)

Submission:

• Who:
  • The foreign national (for self-employed or changes)
  • The employer or the foreign national (for employed)

  • Immigration Office of the province
  • Electronically
• When: During the validity of the current authorization

Fees:

• Vary according to type of modification
• Generally Form 790 code 052

Timeframes:

• Resolution: 3 months from submission
• Without notification = deemed approval by positive silence (in most cases)

Important:

• The modification does not extend the duration of your current authorization
• Maintains the original expiration date
• Upon renewal, you will already have the new type of authorization

After Approval:

• New TIE not necessary (unless you renew)
• The modification is noted in your file
• You can exercise the new activity immediately
