📋 Requirements
  • Not be a citizen of the EU, EEA, or Switzerland
  • Not be in an irregular situation in Spanish territory
  • Have no criminal record in Spain and in countries of residence for the last 5 years
  • Not appear as inadmissible
  • Not be within the period of commitment not to return
  • Not represent a threat to public order, security, or public health
  • Pay the corresponding fee

Project Requirements:

  • Meet the requirements that legislation demands of nationals for the opening and operation of the activity
  • Possess sufficient accredited professional qualification or experience
  • Professional association membership when required (regulated professions)
  • Prove that the planned investment is sufficient
  • Prove impact on job creation (including self-employment)
📄 Required Documentation

General Documents:

  • Official application form (EX-07)
  • Complete copy of passport or travel document
  • Criminal record certificate from countries of residence for the last 5 years

Authorizations and Licenses:

  • Retail businesses and services (surface area ≤ 750m²):
    • Declaration of responsibility or prior communication
    • Proof of payment of the corresponding tax
  • Other activities and professional services:
    • List of required authorizations/licenses
    • Status of procedures for their obtainment
    • Certifications of application before agencies

Professional Qualification:

  • Documentation proving professional capacity and qualification
  • Homologation and/or recognition (regulated professions)
  • Professional association membership (if applicable)

Sufficiency of Investment:

  • Documentation proving sufficient planned investment
  • Documentation on job creation (including self-employment)

Assessment Report (Optional): Can be proven through a report from:

  • National Federation ATA
  • UPTA (Union of Professionals and Self-Employed Workers)
  • CIAE (Intersectoral Confederation of Self-Employed Workers)
  • OPA (Organization of Professionals and Self-Employed Workers)
  • UATAE (Union of Associations of Self-Employed Workers)

Important:

  • Foreign documents translated by a sworn translator
  • Foreign public documents legalized or apostilled
  • Application from Consulate or electronically (Mercurio)

Fees:

  • Form 790 code 052, section 2.1.3
  • Form 790 code 062, section 3.3.1 (if duration ≥ 6 months)

Processing Time:

  • Maximum 3 months from submission
  • Administrative silence: rejection
