A Recognized Family Right

The Temporary Residence Authorization for Family Members of Spaniards is a specific permit for foreign persons who have direct family ties with Spanish citizens. It is more agile than other procedures and recognizes that family life is a fundamental right.

Family Members Who Can Apply:

  • Spouse or registered/stable partner of a Spaniard
  • Children under 26 years old (or dependent adults or with disabilities)
  • Ascendants (parents, grandparents) of the Spaniard or their partner
  • Parents/guardians of Spanish minors in their care

Procedure Information

📋 General Requirements
  • Not be a citizen of the EU, EEA, or Switzerland
  • Have a family tie with a person of Spanish nationality
  • Live together with the Spanish family member (fundamental requirement)
  • The tie must be maintained throughout the validity of the authorization
  • No criminal record in Spain and countries of residence
  • Not represent a threat to public order or security
  • Not suffer from diseases with serious public health repercussions

Important:

  • The tie may have been created anywhere and at any time
  • No minimum prior residence time of the Spaniard in Spain is required
👨‍👩‍👧‍👦 Family Members Who Can Apply

Spouse:

  • Over 18 years old
  • Without divorce, annulment, or legal separation
  • No marriages in fraud of law

Registered Domestic Partnership:

  • Over 18 years old
  • Registered in public registry of EU/EEA/Switzerland
  • Without cancellation of registration
  • Cannot have marriage AND registered partnership (incompatible)

Stable Partner (unregistered):

  • Over 18 years old
  • Prove cohabitation analogous to marital for minimum 12 continuous months
  • No prior period required if there is common offspring
  • Cannot have marriage/registered partnership AND stable partner

Children:

  • Children of the Spaniard or their spouse/partner
  • Under 26 years old, OR
  • Over 26 years old dependent on the Spaniard, OR
  • Any age with disability requiring support

Ascendants:

  • Parents, grandparents of the Spaniard or their spouse/partner
  • When living dependent on them and lacking family support in origin, OR
  • When humanitarian reasons concur

Parent of Spanish Minor:

  • Guardian of minor of Spanish nationality
  • Have the minor in their care and live with them
  • Be up to date with obligations regarding the minor

Caregivers:

  • Family member up to second degree
  • Of the Spaniard with recognized dependency (grades I, II, or III - Law 39/2006)
  • Only ONE family caregiver can be authorized
📄 Required Documentation

General Documents:

  • Official application form EX-19
  • Copy of complete valid passport or travel document
  • Criminal record certificate from countries of residence
  • Medical certificate proving no serious diseases

Family Tie Documentation:

For Marriage:

  • Literal marriage certificate (Spanish)
  • Birth certificate of the Spaniard

For Registered Partnership:

  • Certificate of registration in public registry
  • Documentation proving it is NOT cancelled

For Stable Partner:

  • Proof of 12 months cohabitation: joint empadronamiento, common contracts, joint bank accounts, etc.
  • Or birth certificate of common child
  • Witness statements (if applicable)

For Children:

  • Literal birth certificate
  • If over 26: documentation proving dependency or disability

For Ascendants:

  • Birth certificate proving relationship
  • Documentation proving dependency or humanitarian reasons

For Caregivers:

  • Dependency recognition resolution
  • Relationship documentation

Documentation of the Spaniard:

  • Spanish DNI or passport
  • Birth certificate (in some cases)
  • Empadronamiento certificate
