Gender violence is one of the hardest and most traumatic experiences a person can suffer. When you also find yourself in an irregular administrative situation, fear and vulnerability multiply. But Spanish law protects you, regardless of your migratory status.

Comprehensive and Immediate Protection
The Residence and Work Authorization for Victims of Gender Violence is a special permit granted independently of your administrative situation. It does not matter if you are irregular, if you are on a tourist visa, or if your permit expired. If you are a victim, you have the right to this permit and to all the protection of the State.
Types of Authorization:
- Provisional: From the moment of the protection order or report from the Public Prosecutor's Office
- Definitive: Once victim status is accredited
- Extensible to sons and daughters minors and adults with disabilities
- Without administrative fees

Procedure Information
📋 Requirements
Regardless of Your Administrative Situation:
- This permit is granted independently of your migratory status
- You can request it even if you are irregular, on a tourist visa, or with an expired permit
Accreditation of Gender Violence: Through any of these documents:
- Protection order issued by judicial authority in criminal proceedings
- Report from the Public Prosecutor's Office indicating existence of indications of violence
- Document accrediting victim status according to protection regulations (enabling title or common model)

Beneficiary Family Members: The female victim may request authorization for:
- Minor sons or daughters
- Minors under guardianship
- Adult sons or daughters with disabilities requiring support
- Adult sons or daughters incapable of providing for their needs due to health
- First-degree ascendants (only definitive authorization for humanitarian reasons)
📄 Required Documentation
Victim's Documents:
- Official application form model (EX-17) - Provisional
- Official application form model (EX-18) - Definitive
- Copy of passport or identity document
- Accreditation of gender violence:
- Judicial protection order, OR
- Report from the Public Prosecutor's Office, OR
- Enabling title/common accreditation model
For Definitive Authorization:
- The same documents as the provisional
- Judicial or administrative resolution recognizing victim status
- CRIMINAL RECORDS NOT REQUIRED (special exception for victims)
- NOT REQUIRED to demonstrate financial means
For Family Members (children, ascendants):
- Documents proving family ties
- Identity documents of family members
- Birth certificate (in case of children)
