Regularization in Spain 2026 Step by Step
The extraordinary regularization 2026 process is a marathon. It is not enough to have the documents; you must submit them in the right order and at the right time. In this guide we explain the workflow to legalize your situation under RD 316/2026.
Phase 1: Legal Diagnosis (Before you start)
First, confirm that you meet the entry criterion: having arrived in Spain before January 1, 2026. If you meet this, the next step is to identify whether you are going through the International Protection (EX-31) route or the Extraordinary Arraigo (EX-32) route.
Phase 2: Collection and Apostille (Month 1)
Don't wait for the deadline to approach.
- Request your criminal record certificate from your country. Make sure they bear the Hague Apostille or corresponding diplomatic legalization.
- Translate the documents if they are not in Spanish using a sworn translator accredited by the MAEC.
- Gather invoices, medical appointments, and proof that you have been in Spain for at least 5 months.
Phase 3: Application Submission (May-June 2026)
The application is submitted electronically or in person at authorized points (Post Office, Social Security, Immigration Office).
- Receipt of Initiation: At the time of submission, you will receive a certificate. This document is vital, as it provisionally enables you to work.
Phase 4: Work Authorization and Waiting
From the moment you receive the initiation communication, you can look for employment or register as self-employed. The administration has a period of 3 months to resolve asylum cases and similar deadlines for extraordinary arraigo.
Phase 5: Resolution and Fingerprints (TIE)
Once you receive the "Favorable" decision:
- Pay the card fee (TIE).
- Book an appointment for Fingerprints at the Police.
- In about 30-45 days after the fingerprints, you will collect your physical residence card, valid for 12 months.
