Who Can Enter the Regularization in Spain 2026?
The most frequently asked question these days is: "Do I have a right to papers with the new regularization?". The answer depends on two fundamental factors: when you arrived in Spain and what your current administrative situation is.
The Royal Decree 316/2026 establishes very clear criteria to separate the beneficiaries.
The Golden Requirement: The Entry Date
Not everyone can apply. The Government has drawn a red line:
- Only for those who arrived BEFORE January 1, 2026.
- If you entered Spain on January 2, 2026 or later, unfortunately you cannot benefit from this extraordinary process and you will have to explore the ordinary routes of social or labor arraigo.
The Two Beneficiary Profiles
A. International Protection Applicants (Asylum)
This group has a preferential procedure (Form EX-31). You can enter if:
- You applied for asylum before January 2026.
- You have been in Spain for at least 5 continuous months.
- Your application is still pending or is in the appeal phase after a denial.
- Note: You will have to renounce your asylum procedure once you are granted permanent residence through this route.
B. Extraordinary Arraigo (General Irregular Situation)
For those who are in Spain without papers and arrived before 01/01/2026 (Form EX-32). You must meet at least one of these grounds:
- Labor Ground: Having worked in Spain or having a real job offer.
- Family Ground: Living with minor children, elderly parents, or relatives with disabilities.
- Vulnerability Ground: Having a report of social exclusion or vulnerability issued by authorized entities.
Incompatibilities (Who CANNOT Enter)
- People with serious criminal records that have not been expunged.
- People with a current entry ban in Spain or in the Schengen area.
- People who already have temporary protection (such as displaced persons from Ukraine).
